This Privacy Policy describes how Gemoo.com collects, stores, uses and discloses your personal data. When you use our services, some information will be shared with us. If you are a user or customer, please read this Privacy Policy carefully and make sure that you fully understand it.

Please do not use our Services if you do not wish to provide us with your personal data or any of our services providers. You may also choose not to provide us with “optional” personal data (i.e. “not required” fields on forms), but please keep in mind that without it we may not be able to provide you with the full range of our features and services.

1. Data Collection

What information do we collect?

You will be required to establish an account in order to use certain features of Gemoo Services. If you wish to establish an account, you will be required to provide us with information.

Depending on your use of Gemoo Services, we collect two types of information: personal information and non-personal information.

Personal Information

Personal information identifies you or can be used to identify or contact you. Examples of personal information include your name, IP address, company name, job title, address, e-mail address, telephone number, and billing information.

Non-personal Information

Non-personal information is information that cannot be used to identify or contact you, including demographic information (such as age, profession, company industry, gender, current location, or zip code), browser types, domain names, and statistical data involving the use of the Gemoo Services. Certain non-personal information may be considered a part of your personal information if it were combined with other identifiers (for example, combining your zip code with your street address) in a way that enables you to be identified. But the same pieces of information are considered non-personal information when they are taken alone or combined only with other non-personal information (for example, your account preferences).

Data you upload to Gemoo Cloud Services

When you use Gemoo products, Gemoo Cloud Services are intended to be an easy and customized way for you to store your files, including recordings, uploaded videos, images, texts, and other media that can be uploaded. Therefore, except for the general information listed above, we also collect the stuff you choose to store on Gemoo Cloud Services. However, it is important to note that your stuff on our cloud will only be used to provide the Gemoo Cloud Services to you and will not be used for any other purpose. We do not access, view, or utilize any of your uploaded data.

2. Data Uses

How do we use your information?

In general, we use the information collected for business purposes, to provide you with a great overall experience using Gemoo Services. We indicate the specific purposes of using the information below:

Identification, authentication and access

We use your information to verify your identity when you access your account. If you choose to link your account with us to a third-party account (such as your Google and Facebook account), we use the information you allowed us to collect from those third parties to facilitate account creation and logon process for the performance of the contract.

Operating our services

We use your information to provide and maintain our services, and to allow you to participate in interactive features of our services.

Customizing your experience

We use your information to customize our services for you, which may include remembering your preferences, such as volume level and speed of play.

Analysis

We analyze your information to improve our services and enhance your experience. We also use information collected from cookies and other technology to improve our services and enhance your experience with them.

Marketing and advertising

We and/or our third-party marketing partners may use your information for our marketing purposes, to develop and display personalized content and advertising tailored to your interests and/or location. However, please note that we will not sell your data to any third party for the purposes of marketing or advertising, or any other purposes.

Sending newsletters

We may send you newsletters, alerts, promotions, and other emails from Gemoo. You can unsubscribe from these mailing lists as required by law.

3. Data Disclosure

When do we disclose information to third parties?

We will not disclose any information to third parties outside of Gemoo, except under the following circumstance:

Legal obligations

We may disclose your information when we are legally required to do so in order to comply with applicable law, governmental requests, a judicial proceeding, court order, or legal process, such as in response to a court order or a subpoena (including in response to public authorities to meet national security or law enforcement requirements).

With your consent

We may process your data if you have given us specific consent to use your personal information for a specific purpose.

Third party services

Some of our products may use third-party services, such as Wordance and Clippa use third-party media materials, which enable users to directly select them as the background music for their Wordance videos.

Gemoo may share information with third-party services who perform services for us or on our behalf and require access to such information to do that work. Third-party services are not owned or controlled by Gemoo and third parties that have been granted access to information may have their own policies and practices for its collection, use, and sharing. Please check the permissions, privacy settings, and notices for these third-party services, or contact the provider for any questions. With other users

Your information, such as name, email address or reaction (such as likes and comments) to content, may be shared with the content poster as part of content viewer information.

4. Data Security

We have implemented generally accepted industry standards to protect the security of any personal information we process, so that your information is treated securely and in accordance. More details can be found in our Security Policy.

However, please be aware that no electronic transmission over the Internet or information storage technology is 100% secure, so we cannot guarantee that hackers, cybercriminals, or other unauthorized third parties will not be able to defeat our security, and improperly collect, access, steal, or modify your information.

6. Region-Specific Privacy Rights

European Economic Area (EEA) and the United Kingdom (UK)

Users in the EEA and UK have certain privacy rights under EU and UK law, including the General Data Protection Regulations (GDPR) and UK Data Protection Act 2018.Our Privacy Policy complies with these laws, and you have the following data protection rights:

The right to access, update or delete your personal information

Although we do hold some information about you (See “Data Collection”), Gemoo doesn’t have access to your content created on Gemoo. Subject to certain limitations, you have the right to request access to the information we hold about you, and the right to request that your personal information be updated or deleted.

You have the right to correct your information if it is inaccurate or incomplete.

The right to object and restrict

You have the right to object and restrict our processing of your information.

The right to withdraw consent

You have the right to withdraw your consent at any time. Please note that this will not affect the legality of the processing before its withdrawal.


United States (US)

Users in California have certain privacy rights under California Consumer Privacy Act (CCPA). Our Privacy Policy complies with CCPA, and you have the following data protection rights:

The right to delete

You have the right to request that we delete some or all of the personal information that we have about you. Please note that the requests to delete data may require the deletion of your entire account, which includes your content.

The right to know

You have the right to know: (a) the personal information that we collect about you; (b) the purposes for using collected information; (c) the categories of third parties to whom we have disclosed your personal information.

The right to non-discrimination

We will not discriminate against you if you exercise your privacy rights. Specifically, we will not: deny access to users who exercise their rights; charge different prices to users who choose to exercise rights; or provide a different quality of service.

You may send us a request to utilize your rights to cs@gemoo.com. Please note that the services we provide may be adversely affected depending on how you may wish to exercise these rights.

7. Children’s Privacy

The Gemoo Services are not designed for or directed to children under the age of 13. We comply with Children’s Online Privacy Protection Act (COPPA) and commit to protecting the privacy of children. We do not collect personal information from any person we actually know who is under 13 and will only do that if the parents allow us to.

8. Changes to this Privacy Policy

We will update this Privacy Policy as necessary to stay compliant with relevant laws. If we do, the link to the policy on our site will indicate that the policy has been changed. We encourage you to periodically review the privacy policy for the latest information on our privacy practices.
